Terms of Service

Please read these terms carefully before using our dispatch services. Last updated June 1, 2026.

1. Services Provided

Trucking With PHP ("Company") provides truck dispatch, load booking, rate negotiation, and back-office support services to licensed motor carriers. We act as an agent of the carrier, not as a freight broker or carrier ourselves. All loads booked are subject to carrier approval before confirmation.

2. Dispatch Fee

Our dispatch fee is 10% of gross load revenue (or as otherwise agreed in writing). This fee is deducted from each load settlement before payment to the carrier, or invoiced weekly depending on your payment arrangement. No fee is charged for loads that do not move.

3. Carrier Responsibilities

Carriers must maintain active MC/DOT authority, valid cargo and liability insurance meeting minimum requirements, and all required operating permits. Carriers are responsible for all safety, compliance, and operational decisions. Trucking With PHP does not control how loads are transported.

4. No Forced Dispatch

Trucking With PHP operates on a no-forced-dispatch basis. Carriers have the right to accept or reject any load presented. We do not penalize carriers for declining loads, provided reasonable notice is given to avoid service failures.

5. Limitation of Liability

Trucking With PHP is not liable for cargo claims, accidents, driver behavior, delays, or any losses arising from the transportation of freight. Our liability is limited to the dispatch fees paid in the 30 days preceding any claim.

6. Termination

Either party may terminate services with 7 days written notice. Carriers remain responsible for completing any loads already booked and confirmed at the time of termination. Fees for those loads remain due to Trucking With PHP.

7. Governing Law

These terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in the courts of Guilford County, North Carolina, or through binding arbitration if agreed by both parties.
